law because Imran Khan is not an Indian citizen and participated in the protest. As we had reported earlier, he was also detained during the demonstration. Sujata Dwivedi is tracking the latest breaking news developments for us. She joins us live from Mumbai this morning. Sujata, what is Imran Khan's precise immigration status and what are the specific grounds that authorities have cited for directing him to leave India by the 28th of October? that there has to be an action taken against Imran Khan for participating in such demonstrations despite not being an Indian citizen. And this is a clear violation of the Immigration Act that has been put in place and reason being that for now, he has been issued a circular stating that he has to leave the country. And we know that Imran Khan, there's no official statement from his end for now or either from his team and family members. But we know that he was detained by the police while he was on his way to participate in the demonstration. that was held at August Kranti Maidan on the 10th of October and not just first but even before that he had been detained once for participating at Shivaji Park in one of these protests. So Imran Khan has been vocal about the protests that were held lately by the CJP as well as several other of these groups at Shivaji Park and August Kranti Maidan and henceforth while he turned out to be at the protest himself that is when he was detained and thereafter BJP leader Kirat Sumaya he took up the matter he had to was Gau Devi police station where he demanded that There has to be a notice that is to be issued for the for either detention or for an FIR to be registered against Imran Khan and thereafter asking him to leave India for him not being a citizen of the country and despite that participating in protests which are internal matters of the nation. Over to you. All right. Sujatha, do stay on with us as we decode all the latest developments. We've got Clyde Castro from the NCP joining us. Glad to have you on the breakfast show. Thank you for your time. We're given to understand that Imran Khan, after participating in a peaceful protest, is now being asked to leave the country on the 20th of October. First of all, sir, do you have any intel on why he has been asked to, what relevant security threats he has been basically been categorized under and your first thoughts as well? Well, I have no idea about this. What I'm hearing is all from what you are saying right now. But the fact is, the last couple of days, this issue has been going on. I want to make it very clear that every citizen or anybody who comes in this country has to abide by the law of the land. So if anybody is not abiding by the law of the land, it is the government's job, it is the police's job to take care of all the required documents and everything. So if somebody is going against the law, then whatever decision has to be taken, we have to abide by it. But having said that, what I hear from you also is that he's been asked to leave the country because he's not a citizen of India. But there are many people in our country who are here, who are not citizens, but they are around and doing a lot of things that are not acceptable by the law of our country. So I think the government should show proactiveness there also and make sure that we don't have these kind of people in our country. Alright, what is your message to the government then, sir, who basically says that a foreign national's participation in a peaceful protest is problematic and it's sufficient grounds for them to be directed to leave the country? Like I said, whoever goes against the law, whoever conducts himself or herself against the law, appropriate action has to be taken. But it should not be selective. The government should not be selective. They need to follow the same measuring rod for everybody who's doing things like this. Right. So thank you so much for joining us. On behalf of the NCP, SB, Sujata continues to be with us live from Mumbai. At this moment, do we have any clarity on whether Imran Khan has been reprimanded to leave India because he participated in a peaceful protest? Is that the stated ground for the notice or have police cited a separate violation as well? so far what we know is that Imran Khan, who happens to be a US citizen, had participated in a protest demonstration that was held at the August Kranti Maidan in Mumbai. And that is the reason why we saw the entire matter escalating up. Kirat Sumaiya, he not only requesting the Mumbai police, but also the Ministry of Home Affairs asking them to issue a circular to stop Imran Khan from participating in such protests and asking him to leave the country. And therefore, action should be taken against him. And thereafter, we know that the circular has now been issued against Imran Khan asking him to leave the country by 28th of October. Now what needs to be known here is that this action has been taken after the immigration act and its rule have been violated because Imran Khan participated in a matter concerning the political situation in Maharashtra and the country right now and holding a right situation for the same is a clear violation of the immigration act and because of that the immigration department has to now taken cognizance of the case. Okay. Imran Khan. Rather just hold that thought for a moment we've got Shaina NC joining us on behalf of the BJP live on the broadcast currently. Ma'am, thank you for your time. You believe foreign nationals should be free to participate in peaceful political protests in India or should that freedom actually be subject to restriction based on immigration status and specific visa conditions considering Imran Khan has now been directed to leave India by the 28th of October? Firstly, I belong to the Shiv Sena. So please can correct it. And I beg your pardon. I sincerely apologize for that. No, no, no problem. But see, what is the ESI really doing? It is about a verification of who are legit voters and who are not. You choose to agitate. Yes, welcome. But how can you welcome Imran Khan agitating who is a US citizen? do understand that this is not the first time you have certain people who have spread all kinds of narratives and conspiracy theories. The police also needs to do its job, right? The police also needs to ensure that if there is a US citizen who is agitating and agitating, if it has a repercussion on the law and order situation, then we also need to react and respond accordingly. I'm not for one minute taking on the case of Imran Khan or anyone else. But if you are a foreign national, there are questions that do come up when it comes to our own security. And Kirit Somaya's argument, from what one reads in the media, is that Imran Khan is a US citizen. He's an OCI card holder. And a foreign citizen participating in a political protest that's the citizenship act which is section 7b of the immigration and foreigners act so if there is a violation there then it should be both ways that the investigation and then the Mumbai police takes a call. Miss Shaina N C thank you so much for joining us on behalf of the Shiv Sena. Ma'am is saying that if there is an issue then investigator should tend to the problems that have been highlighted but we've got Ram Kadam on behalf of the BJP on the broadcast currently. Mr. Kadam What safeguards ensure that immigration powers, like for OCI holders, in this case for Imran Khan, are not used selectively against people who criticize the government or who peacefully protest or participate in demonstrations against constitutional authorities? First of all, Mr. Imran Khan is not a citizen of this country. And being a foreigner, how can he take a part in any agitation? He cannot. He can come to this country, he can roam around, that's fine. But being a part of any agitation is a serious offence. And that's the reason why police has given him notice and asked him to go back to his own country. Now the problem is, see the sequences and timing. When Mr. K. is a party. We seem to have lost your voice. Are we still audible to you, Mr. Kadam? Allow me to complete. Allow me to complete. Allow me to complete. When Mr. Dip K came back from US and immediately after that, he has started all these agitations, which are completely baseless. See, he can ask questions to Election Commission, no problem about it. But he has to give some proofs. There are no. without proof without any example how can he you know uh the raise the questions that's the point now Imran Khan will go back but the problem is what about ring such questions which which are bestless who have been working against this country in that Alright, Mr. Kadham, thank you so much for joining us on behalf of the BJP. We are of course looking at what safeguards ensure that immigration powers are not used selectively against people who basically peacefully protest, who criticize the government, who happen to be OCI holders. I have to also inform you that OCI rules do not expressly list attending a public protest as an activity for which every cardholder must obtain prior special permission. This doesn't mean that all forms of political activity are automatically permitted, but the OCI card holders do have certain rules that they need to pertain to.
